Even though the JBI specification is not clear about that, in case of failure of send, the exchange is not given to someone else, so it makes sense to return ownership to the sender.
Note that getting ownership back does not mean the exchange can be sent again because it will be considered as terminated by the router.
But at least it will give the possibility to the sender to read it if needed.
